Welcome to Myburgh & Co. These Terms and Conditions apply when you access our website, create an account or purchase products from us. By using this website or placing an order, you agree to these Terms and Conditions.
This website is operated by Myburgh & Co Pty Ltd, ABN 99 697 889 919. In these Terms, “we”, “us” and “our” refer to Myburgh & Co.
1. Eligibility
You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order through this website. You are responsible for ensuring that the information you provide is accurate and complete.
2. Product Information
We take reasonable care to ensure that product descriptions, ingredients, images and prices are accurate. Packaging, colours and product appearance may vary slightly from images displayed on different screens. Product availability and formulations may change without notice.
Products marked “Coming Soon”, “Out of Stock” or otherwise unavailable cannot be supplied until stock becomes available. Displaying a product on our website does not guarantee its availability.
3. Skincare Information
Our products are cosmetic skincare products and are not intended to diagnose, treat, cure or prevent any medical condition. Information on this website is general in nature and is not medical advice.
Individual results may vary. Please review the ingredient list and directions before use. Patch testing is recommended before introducing a new product. Discontinue use if irritation occurs and seek advice from a qualified health professional when appropriate. Keep products out of reach of children and use them only as directed.
4. Prices
Unless stated otherwise, prices are shown in Australian dollars and include GST where applicable. Delivery charges and any other applicable costs will be displayed before you complete checkout.
We may change prices, promotions and product availability at any time. Changes will not affect orders already accepted by us.
5. Orders
Placing an order is an offer to purchase products from us. An automated order confirmation acknowledges that we received your order but does not necessarily mean that it has been accepted.
We may decline or cancel an order before dispatch where reasonably necessary, including when a product is unavailable, payment cannot be authorised, an incorrect price or description was displayed, or we reasonably suspect fraud or misuse. If we cancel an order after payment has been received, we will refund the relevant amount.
6. Payments
Payments are processed securely through PayPal or Stripe. Your use of either payment service may also be subject to that provider’s terms and privacy practices.
You confirm that you are authorised to use the selected payment method. We are not responsible for delays caused by a payment provider declining or reviewing a transaction.
7. Shipping and Delivery
Shipping charges and estimated delivery timeframes are displayed during checkout or in our Shipping Policy. Delivery estimates are provided as a guide and may be affected by carriers, weather, public holidays, customs or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you notice an error. We cannot guarantee that an address can be changed after an order has been processed.
8. Returns and Consumer Guarantees
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a refund, replacement or another remedy if a product is faulty, unsafe, not of acceptable quality, does not match its description or is not fit for a disclosed purpose.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified.
Change-of-mind returns, where offered, are governed by our Returns Policy. Hygiene-related conditions may apply to change-of-mind returns of opened skincare products, but these conditions do not limit your rights where a product fails to meet a consumer guarantee.

9. Promotions and Discount Codes
Promotions and discount codes are subject to their stated conditions, availability and expiry dates. Unless expressly stated otherwise, discounts cannot be combined, exchanged for cash or applied retrospectively.

- interfere with the security or operation of the website;
- introduce malicious software or attempt unauthorised access;
- copy or commercially exploit website content without permission; or
- provide false, misleading or deceptive information.

The Myburgh & Co name, logos, product names, packaging, photographs, graphics, website design and written content are owned by or licensed to us. You may view the website for personal shopping purposes, but you must not reproduce, distribute, modify or commercially use our content without written permission.

Our website may use or link to third-party services, including payment, delivery and social-media providers. We do not control third-party websites and are not responsible for their content, availability or privacy practices.
13. Liability
To the maximum extent permitted by law, we are not liable for loss caused by misuse of a product, failure to follow directions, an undisclosed allergy or sensitivity, unauthorised access to your account, or events outside our reasonable control.
Where liability cannot lawfully be excluded, our liability remains subject to all rights and remedies available under applicable law, including the Australian Consumer Law.

These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts having jurisdiction in that State or Territory, subject to any rights you have under applicable consumer law.
